Terms of Service

TERMS OF SERVICE – KINISON PHOTOGRAPHY

1. Agreement

By booking services or downloading, accessing, or using any images delivered by Kinison Photography (“Photographer”), the client (“Client”) agrees to the terms outlined below.

2. Booking & Payment

  • A non-refundable retainer is required to secure any session or event date.

  • The remaining balance is due on or before the session date unless otherwise agreed in writing.

  • No images will be delivered until full payment is received.

3. Cancellations & Rescheduling

  • The retainer is non-refundable under all circumstances.

  • Sessions may be rescheduled once without penalty if notice is given at least 48 hours in advance, subject to availability.

  • Failure to appear or same-day cancellations may result in forfeiture of the retainer and require a new booking fee.

4. Image Delivery

  • Delivery timelines vary based on workload and project type but typically range from 3–14 business days.

  • Images are delivered via online gallery or digital download unless otherwise specified.

  • RAW files are not released.

5. Usage Rights

  • Client receives a personal or agreed commercial license for delivered images.

  • Images may be used for personal branding, social media, and print unless restricted in writing.

  • Client may not resell, license, or transfer images to third parties without written permission.

6. Copyright

  • All images remain the exclusive copyright of Kinison Photography.

  • Photographer retains the right to use images for portfolio, marketing, website, social media, and promotional purposes unless a written agreement states otherwise.

7. Model Release

  • Client grants permission for images to be used by Photographer for promotional and portfolio use unless explicitly declined in writing prior to the session.

8. Editing & Style

  • Editing style is at the sole discretion of the Photographer.

  • Requests for extensive retouching or stylistic changes outside the Photographer’s standard workflow may incur additional fees.

9. Client Conduct

  • The Photographer reserves the right to end a session early without refund if there is abusive, unsafe, or inappropriate behavior from the Client or attendees.

10. Limitation of Liability

  • Photographer is not responsible for circumstances beyond control, including weather, venue restrictions, equipment failure, or unforeseen events.

  • Liability is limited to the amount paid for services.

11. Agreement Acceptance

Booking a session, making payment, or downloading images constitutes full acceptance of these terms.
